IFA Statement on NLRB considering rulemaking to address joint-employer
WASHINGTON, May 9—International Franchise Association SVP of Government Relations & Public Affairs Matt Haller welcomed the National Labor Relations Board (NLRB) announcement it would consider rulemaking to address the standard for determining joint-employer status under the National Labor Relations Act:
“The ongoing uncertainty created in 2015 by the NLRB’s radical expansion of the joint employer standard continues to present significant challenges for franchisors and franchisees. This uncertainty has led to needless and costly litigation, a reduction in the services franchisors provide franchisees as part of contractual agreements and fewer new businesses and jobs being created by the franchise business model. Today’s announcement is an acknowledgement the Trump administration recognizes the importance of providing clear rules for employers on joint employer in the long term, however IFA continues to primarily advocate for the Save Local Business Act in Congress as the best way to address the full scope of the joint employer uncertainty facing franchise businesses in both the NLRA and the FLSA.”
